Terms of Service

These terms cover the website design, build, hosting, and maintenance services provided by BMW Web Designs (“we,” “us,” or “our”). By hiring us or submitting the project questionnaire, you (“you” or the “client”) agree to these terms.
1. What we provide
We design and build a custom website for your business, then host and maintain it for you. Depending on your plan, the service includes:
- A custom-designed website built around your business.
- Hosting and an SSL certificate, kept live on our infrastructure.
- Registration and management of your domain name on your behalf.
- A set number of content edits each month, based on your plan.
2. Pricing and payment
Our pricing has two parts: a one-time build fee to design and launch your site, and a recurring monthly fee that covers hosting, your domain, and edits. The exact amounts are the ones quoted to you and shown on your plan.
- The build fee is due before your site goes live unless we agree otherwise in writing.
- The monthly fee renews automatically each month until you cancel.
- We may adjust the monthly fee with at least 2 weeks’ notice before your next billing cycle. You can cancel before any change takes effect.
- Fees are exclusive of any applicable taxes.
- If a monthly payment fails and stays unpaid, we may pause or take your site offline until it is resolved.
3. Your monthly plan
Your plan includes a set number of edits per month (for example, updating hours, prices, photos, or text). Edits do not roll over to the next month. Larger changes, like adding new pages or features beyond your plan, may be quoted separately as add-ons before we start.
4. Domain and hosting
While you are subscribed, we register and manage your domain and host your site on our accounts so you never have to deal with the technical side. You may request that your domain be transferred to you at any time, and we will help you move it. Hosting your site on our infrastructure is part of the monthly service and is not available separately.
5. Cancellation
There is no long-term contract. You can cancel your monthly plan at any time. When you cancel:
- Your plan stays active through the end of the current paid month.
- The one-time build fee and any already-paid monthly fees are non-refundable.
- After your final paid period ends, we take your site offline and stop managing your domain.
- If you want to keep the site, you can buy it out or have the files and domain transferred to you. We will quote that to you on request.
6. Ownership and content
You own the content you give us, such as your business name, logo, photos, and text, and you confirm you have the right to use it. We own the design and code we create until your build fee is paid; once it is paid and while your plan is active, you have a license to use your site for your business. If you buy out the site, full ownership of the final files transfers to you.
We may feature your finished site in our portfolio and on social media as an example of our work. Tell us in writing if you would prefer we do not.
7. Your responsibilities
- Give us accurate information and the content we need to build your site.
- Respond to questions reasonably promptly so your build is not delayed.
- Make sure anything you send us (images, text, logos) does not infringe anyone’s rights.
- Use your site only for lawful purposes.
8. Turnaround and revisions
We aim to launch most sites within about 48 hours of receiving everything we need. That is a target, not a guarantee, and it depends on how quickly you provide content and feedback. Edits are handled within your plan’s normal turnaround.
9. Disclaimer
We build your site with care, but we provide it “as is.” We do not guarantee any specific business result, amount of traffic, search ranking, or revenue. We are not responsible for outages, issues, or downtime caused by third-party providers such as our hosting, domain registrar, or payment processor.
10. Limitation of liability
To the fullest extent allowed by law, our total liability for any claim relating to our services is limited to the amount you paid us in the three months before the claim. We are not liable for indirect or consequential losses such as lost profits or lost business.
11. Changes to these terms
We may update these terms from time to time. The current version is always posted on this page with its last-updated date. Continuing to use our services after a change means you accept the updated terms.
